The percentage stops. The salary base does not.

Almost every conversation about the NYPD pension after 20 years focuses on the percentage. For Tier 3 that is 50% of final average salary at 20 years, and it does not rise no matter how long you stay. That part is true, and it is also only half of the machine.

A pension is a percentage times a salary base. The longevity enhancement leaves the percentage alone and lifts the base. A career police officer who reaches 25 years has a portion of the pension computed as though paid at a higher rank's salary rate, and that is a different lever than the one everyone argues about.

It matters because a higher rank's top pay rate is meaningfully above a police officer's, so applying even part of the pension at that rate raises the number in a way the flat 50% never shows.

What the enhancement actually gives a police officer

The Fund's June 2026 Summary Plan Description states it directly. Members who retire in the rank of Police Officer, who have served twenty-five years in the rank of Police Officer, have a portion of their pension benefit calculated using the highest salary rate of a 3rd Grade Detective. Members who have served thirty years in the rank have a portion calculated using the highest salary rate of a Sergeant.

This is not a proposal or a pending bill. It sits in the New York City Administrative Code at section 14-111, added by Chapter 55 of the Laws of 2024, effective April 20, 2024. The statute frames it as a first grade police officer at 25 years gaining the same pension fund rights as a third grade detective who served two years at that detective's highest salary rate, and at 30 years, the rights of a sergeant at the sergeant's highest rate.

So the officer never held the higher rank. The enhancement treats a portion of the pension as if they were paid at it, purely on the strength of time served.

Two things count, and only two

The SPD is specific about what fills the years-in-rank requirement: only Retro Military Seniority, Childcare Leave, and Active Military Service performed while a member of the NYPD count toward the 25 and 30 year thresholds. Ordinary breaks in service do not, and the clock is time in the rank of Police Officer, not total city service.

Why this reshapes the 20 versus 25 decision

The standard framing of staying past 20 is that Tier 3 gets you nothing extra because the percentage is capped. That framing is incomplete. At 25 years the salary base jumps to a 3rd Grade Detective's rate, and at 30 to a Sergeant's, for the portion the statute covers.

This is not an argument that you should stay. It is an argument that the number you are comparing against your alternatives is probably understated if you leave it at a flat 50% of your own police officer salary. The honest comparison prices the enhancement in.

It also stacks with the other 25 year features that rarely get counted in the same conversation. Full escalation, the inflation adjustment, begins at 25 years, and certain longevity payments become pensionable at 25. Three separate things move at that same mark, and none of them is the base percentage everyone watches.

The promoted-rank steps, and where they sit in the law

The June 2026 SPDs also print a schedule for members who retire as a Detective, Sergeant or Lieutenant: with at least three years in the rank you retire in, 5% of that rank's highest pay is added, for a two year aggregate period, to the salary your pension is computed on at 25 years of service, 10% at 30, and 15% at 35. Those steps are enacted law. They sit in Administrative Code section 14-114(d), added by the May 2025 State budget, Chapter 55 of the Laws of 2025, effective May 9, 2025. One rule to know: a member who takes this increase does not also take the Police Officer step in section 14-111. The two do not stack.

If you went looking for this yourself, you might reasonably conclude the opposite, and it is worth explaining why. A standalone bill with the identical language, Senate Bill S4262, still sits in committee, because its substance was absorbed into the budget instead of passing on its own. The abandoned duplicate makes the benefit look pending when it is already in force. The statute also says "five per centum" rather than "5%", so a keyword search of the Code comes up empty. Both of those tripped us for part of a day, and we only settled it by reading the section itself.

At Captain and above, the enhancement works through the salary referenced rather than a percentage: five to ten years in the rank of Captain references a Deputy Inspector's salary, ten to fifteen an Inspector's, and fifteen or more a Deputy Chief's. That structure is long standing law in section 14-114(c). Whatever your rank, the exact figure should come from the Police Pension Fund, because it depends on current contract pay rates for a rank you may never have held.

How to price it before you decide

You cannot read this enhancement off your own salary, because it is measured against a rank you never held. The exact figure depends on the current highest salary rate for a 3rd Grade Detective or a Sergeant, and on how the Fund applies the portion to your specific service. That is a number to get from the Police Pension Fund, not to estimate off a pay stub.

What you can do before that conversation is stop treating 25 and 30 years as flat. If your plan for staying or leaving assumes the pension is simply 50% of your final average salary at any point past 20, it is missing the base enhancement, the escalation start, and the longevity pensionability change, all of which land at 25.

Does an NYPD Tier 3 pension increase after 20 years?
